| 7.1 |

The Customer and Two Oars each agree to comply with all applicable UK Data Protection legislation in connection with the Services and the Data. In particular: |

7.1.1 |

the Customer agrees to ensure that it has all appropriate consents and licences to enable it to load, store and process on the TO System all personal data that is loaded on to the TO System by or on behalf of the Customer and for these purposes the Customer acknowledges that the TO System or elements thereof may be located outside of the European Union or the European Economic Area and accordingly such personal data may be stored and processed outside of the European Union or the European Economic Area; |

7.1.2 |

Two Oars agrees to use and process such personal data only to the extent reasonably necessary to enable it to provide the Services and as otherwise permitted by this Agreement. |

The Customer consents to Two Oars using and/or disclosing Personal Data in accordance with the Two Oars Privacy Policy which is set out at here as follows: |

7.2.1 |
|
processing the order set out in the Order Form or changes to the information set out in the Order Form, which may involve credit checking by a credit reference agency who may record that a credit check has been made; |

7.2.2 |
|
disclosing Personal Data including account details to a bank, credit card operator or other payment processor for the purposes of setting up a continuous payment authority; |

7.2.3 |
|
providing or arranging for third parties to provide any part of the Services including but not limited to customer care facilities and billing, email and tools and services, which may involve disclosing Personal Data to third parties solely for this purpose; |
|
7.2.4 |
|
providing the Customer with communications about Two Oars services, special announcements including but not limited to instructions, information, changes to the products, services and prices, organisational and administrative changes; and service newsletters and any other relevant information relating to the provision of Two Oars's Services. |

In order to provide the Customer with the Services, Two Oars will attach cookies to the Customer's system that are reasonably necessary to enable Two Oars to identify the Customer and Named Users to understand and facilitate the Customer's use of the Services. Two Oars also uses cookies to ensure that its mailing tools are working correctly. The Customer consents to receiving the cookies. (For more information on cookies please click here) |
